That's is wrote by eBay:

It is prohibited to offer articles with eBay, for whose genuineness of the salespersons cannot guarantee. An exclusion of this obligation is not allowable.

Explanations to this principle

Salespersons are responsible for the genuineness as well as legitimacy of the offered articles.

A salesperson must see for itself of the genuineness of an article before the article is offered. If the genuineness of an article cannot certainly be confirmed, the article cannot be offered with eBay.

Examples for forbidden offers:

" I cannot guarantee the genuineness of this article. Hand over therefore corresponding commandments.
" Antiquity clock - Cartier???"

...but they give permission for this kind of announcement:

"Keine Garantie auf Orginalität".

A while back I notified them about two such offers (genuineness can not be guaranteed), just to see if they would erase them from the board. They did not.

Problem is these guidelines are only valid between seller/bidder and Ebay, not between seller and bidder directly. So you are stuck with the offer as it is.
